Terms & Conditions

These conditions apply whether a contract has been made verbally or in writing. The hirer acts on behalf of all the passengers travelling in the vehicles. If the hirer is a company, group or partnership, an individual must be named as a responsible person. The hirer is responsible for the actions and decisions of all the passengers on board including any additional costs incurred in performing the contract, whether or not they actually travel with the party. The company will only accept instruction from the hirer. If the hirer is not going to travel with the party, a representative must be chosen and the company informed prior to the hire taking place.

The hirer is wholly responsible for providing the detail of the services required in writing/ by fax to the company at all times.

Quotations are given on the basis of the most direct route and on information provided by the hirer. The route used will be at the discretion of the company unless it has been particularly specified by the hirer in which case it will be clearly shown on the confirmation.

All quotations are given subject to the company having available a suitable vehicle at the time the hirer accepts the quotation.

Quotations are given for limousine and driver only and are valid for 28 days. Any additional charges will be separately identified and will be the hirer’s responsibility unless otherwise specified.

Normally, written confirmation by the company is the only basis for the acceptance of a hiring or for a subsequent alteration to its terms.

Payment must pay for the provision of limousine services, before the journey is undertaken. Payment should be made in full on confirmation of reservations, and if paying by cheque or credit card, please ensure that full payment has cleared 10 days in advance of the booking.

Any last minute changes to the requirements by the client must be in writing / by fax and are subject to availability and at least 72 hours (3 days) prior to service.

Should the hirer wish to change the destination or times once on board the vehicle, an additional charge will be levied at £30.00 per hour waiting or £60.00 per hour travelling. Subject to that vehicles availability to operate within the new schedules. This must be paid in CASH to the driver on the occasion. The company will not do additional pick up and drop offs that are not stated on the booking form.

Whilst every effort will be made to arrive at the client’s address or destination punctually the company shall not be liable for late arrival or cancellation due to circumstances beyond its control. In the event of unforeseen delays the company will endeavour to contact the hirer by telephone. It shall be the hirer’s responsibility to allow adequate time to reach their destination. We strongly recommend that Travel Insurance be taken out where appropriate.

The vehicle will depart at times agreed by the hirer and it is the responsibility of the hirer to account for all passengers at those times. The Company will not accept liability for any losses incurred by passengers who fail to follow instructions given by the hirer.

If the hirer wishes to cancel any agreement either the relevant tariff terms and conditions will apply or the following scale of charges will apply in relation to the total hire charge. A 10% administration fee will also be charged in both cases:-

  • (A)  7 days or less, 50% of hire.                    
  • (b)  Day of hire, 100% of hire.

The Drivers retain final discretion over the pick-up and set-down location in compliance With the Road Traffic Regulations and local restrictions at the time of the journey.

All vehicles operate a strict NO SMOKING policy. Although on longer journeys the driver will Make attempts to make a couple of scheduled stops, to enable passengers to get out and have a smoke break.

Use of prohibited substances in our vehicles is banned at all times. Should our drivers become Aware of any such transgressions, we reserve the right to cancel the hire with immediate effect and eject all passengers. We will not be held accountable for any resulting travel costs.

All bookings for key dates and popular busy dates such as school proms, Christmas, New Year Require a 60 days cancellation notice. Failure to do so will result in the full cost of the booking.

We reserve the right to change the vehicle requested for a hire at any time. This includes Colour and the style of the vehicle. We will only do so if we feel the requested vehicle is unfit to carry passengers and will do our best to replace the vehicle with an identical model, if this is not available we or any of our agents will consult with you as soon as possible.

Eclipse Limousines will not be held responsible for financial or personal loss in the event of Mechanical failure. We strive to ensure that all our vehicles are serviced to the manufacturers specifications but cannot be held accountable should the vehicle develop a fault while carrying

Passengers. In the event of a breakdown, we or our agent will do their very best to source a replacement vehicle but are under no obligation to pay alternative travel arrangements.

Any damage caused to the vehicle by the occupants shall be the sole responsibility of the hirer. Any costs associated with repairs must be paid in the time frame agreed upon with the company. An additional daily charge can be imposed should the vehicle be taken out of commission.

The Company and employees of our limousine hire companies (agents) reserve the right to refuse passage to any person(s) that it deems to be unfit to travel in the vehicle. If a driver deems any person(s) to be posing a danger to the vehicle or it’s occupants they reserve the right to terminate the booking with immediate effect. No refund will be given in this circumstance and we cannot be held responsible for any associated costs incurred.

Violence, Foul Language, Intimidation, Antagonism, or any other form of Anti-social behaviour towards the driver or any member of staff of this Company or its agents, will not be tolerated and may result in termination of hire and or police involvement. Termination of hire caused by Anti-social behaviour will render the hirer liable for the full hire charge. Acts of Vandalism or Malicious Damage to the vehicle will be prosecuted.

The Company reserves the right to charge for any glass breakage’s or serious spillages or any damage incurred to the vehicle whilst under hire. The Company will advise the hirer of this in writing as soon as is practically possible. There is NO FOOD to be eaten on board the vehicle.

We reserve the right to impose a valet charge of no less than £100 for cleaning of said vehicle should any passengers damage it through deliberate misuse or illness. The hirer agrees to pay for all costs associated with returning the vehicle to an acceptable standard should they be responsible for causing the damage. The customer irrevocably agrees to indemnify Eclipse Limousines or its servants and agents against any damages or unnecessary costs arising from their hire of the vehicle.

The Customer/consumer/hirer irrevocably agrees to indemnify Eclipse Limousines of all reasonable costs and disbursements arising from Debt Recovery action taken to recover outstanding monies owing, including but not limited to those costs payable to any debt recovery agency used, their servants or agents.

Please be advised that the limousines contain flashing lights therefore presenting a risk to anyone who suffers from epilepsy etc. The decision to travel must be made by a responsible Adult and the company will accept no liability.

When booking children’s parties please note that the children will need to be accompanied by a Responsible adult who will be responsible for the entire party. This means a maximum of 7 children in any one party. Should any of the children require booster seats or any other special
seat as required by law. It is the responsibility of the hirer / adult in charge to supply these and also it is their responsibility to fasten the children in. This is not the drivers responsibility and therefore please do not ask them to perform this task.

Champagne Glasses

It is recommended that the Champagne glasses are not overfilled. We suggest the glasses should be just over half full. Please remember that every road is not as smooth as we would hope. We would not wish your evening to be spoiled by a stain on your Ball Gown or Dinner Suit.

Apart from weddings when a specific dress code is observed, our chauffers will always turn up smartly dressed. Should you require any specific dress code then this MUST be stated on your booking form.

By signing the booking form, you the hirer are agreeing to enter a binding contract.

A Booking Confirmation form will be sent to you for you to check and sign. The signing of this form means that you the hirer are agreeing to enter into a binding contract.
